1. Introduction and Acceptance of Terms

Welcome to beem.pics, a live event photo wall platform operated by beem.pics ("beem.pics", "we", "us", or "our"), based in England and Wales. Our website is located at https://beem.pics.

Please read these Terms and Conditions ("Terms") carefully before using our services. By registering for, accessing, or using beem.pics (the "Service"), you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Service.

By accepting these Terms, you confirm that you are at least 18 years of age. If you are accessing the Service on behalf of a business or other legal entity, you confirm that you have the authority to bind that entity to these Terms.

2. Description of the Service

beem.pics provides a paid platform that enables users to create event photo walls, allowing guests to upload photographs which are then displayed in real time on a live, publicly viewable or event-restricted wall (the "Service").

The Service operates on the following lifecycle:

• Active Period: Once an event is created and payment is confirmed, the event wall will be live and active for 30 days from the event start date. During this period, guests may upload content and the live wall will be fully operational.
• Download Period: Following the end of the Active Period, the event wall will become inactive (no further uploads or live display). However, your account login will remain accessible for a further period, up to 6 months from the original event date, solely for the purpose of downloading your event content.
• Full Deactivation: After 6 months from the event date, the account and all associated content will become fully inactive. Content will no longer be accessible or recoverable unless otherwise agreed in writing with beem.pics prior to this date.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with reasonable notice where practicable.

3. Account Registration

To use the Service, you must create an account by providing accurate, complete, and current information including your name, email address, and payment details. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You must notify us immediately at info@beem.pics if you become aware of any unauthorised use of your account. beem.pics will not be liable for any loss arising from unauthorised use of your account where you have failed to keep your credentials secure.

You may only register one account per individual or organisation. Multiple accounts for the same individual or organisation are not permitted without our prior written consent.

4. Fees and Payment

The Service is subject to fees as set out on our home page at https://beem.pics. All prices are quoted in pounds sterling (GBP).

Payment is required in full at the time of creating an event. We use third-party payment processors to handle transactions securely. By providing your payment details, you authorise us to charge the applicable fees.

All fees are non-refundable except where required by applicable law, including the Consumer Rights Act 2015, or as otherwise set out in our Refund Policy. If you have a concern about a charge, please contact us at info@beem.pics within 14 days of the charge being made.

We reserve the right to amend our pricing at any time. Price changes will not affect events already created and paid for.

5. User Content

5.1 Ownership and Licence

You retain all ownership rights in the photographs and other material you or your guests upload through the Service ("User Content"). By uploading User Content, you grant beem.pics a limited, non-exclusive, royalty-free, worldwide licence to store, process, display, and distribute that content solely for the purpose of providing the Service to you and your event guests.

This licence ends when your content is deleted from our systems in accordance with section 6 below.

5.2 Your Responsibilities

You are solely responsible for ensuring that all User Content uploaded through your event — whether by you or by your guests — complies with these Terms and all applicable laws. You confirm that:

• You own or have obtained all necessary rights, licences, and consents for any User Content uploaded through your event.
• Where User Content features identifiable individuals, you have obtained (or are satisfied that event guests have obtained) the relevant consent from those individuals for the content to be uploaded and displayed.
• User Content does not infringe the intellectual property rights, privacy rights, or any other rights of any third party.
• User Content is not unlawful, harmful, threatening, abusive, defamatory, obscene, discriminatory, or otherwise objectionable.
• User Content does not contain material that promotes violence, hate speech, or illegal activity.
• User Content does not contain sexually explicit material or any content that sexually exploits or endangers minors.
• User Content does not contain commercial advertising or unsolicited marketing material.

beem.pics reserves the right, but is not obligated, to review, remove, or disable access to any User Content that we believe, in our sole discretion, violates these Terms or is otherwise harmful. We may report unlawful content to the relevant authorities.

6. Content Storage and Deletion

User Content uploaded through your event will be stored as follows:

• Active Period (0–30 days from event date): Content is stored and displayed on your live event wall.
• Download Period (30 days to 6 months from event date): The live wall is deactivated. Content remains accessible via your account login for download purposes only.
• Full Deactivation (after 6 months from event date): All User Content associated with your event will be permanently and irrecoverably deleted from our systems. beem.pics will not be liable for any loss of content following permanent deletion.

If you wish to request early deletion of all content associated with your event, please contact us at info@beem.pics. We will action such requests within 7 working days.

It is your responsibility to download and retain any content you wish to keep before the end of the Download Period. We strongly recommend downloading your content well in advance of the 6-month deadline. beem.pics accepts no liability for any failure by you to download content before deletion.

7. Privacy and Data Protection

beem.pics is committed to protecting your personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

beem.pics acts as the data controller for personal data collected through the Service. We collect and process personal data such as your name, email address, payment information, and technical data (including IP addresses and device information) for the purposes of providing and improving the Service.

Full details of how we collect, use, store, and share your personal data, as well as your data rights, are set out in our Privacy Policy available at https://beem.pics/privacy. The Privacy Policy forms part of these Terms.

You have the right to access, rectify, or request deletion of your personal data. To exercise your data rights, please contact our Data Protection contact at privacy@beem.pics.

You are responsible for ensuring that any personal data relating to third parties (including event guests) contained in User Content is handled in accordance with applicable data protection law. Where you are making personal data of guests available through the live wall, you should ensure appropriate notice is given to those individuals.

8. Acceptable Use

You agree not to use the Service to:

• Upload, display, or transmit any unlawful, harmful, defamatory, or otherwise objectionable content.
• Infringe the intellectual property rights, privacy rights, or other legal rights of any person.
• Upload content depicting minors in a sexual or inappropriate manner.
• Attempt to gain unauthorised access to any part of the Service or another user's account.
• Use automated tools to scrape, harvest, or download content from the Service without our express written consent.
• Use the Service to build or develop a competing product or service.
• Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure.
• Transmit any malware, viruses, or other malicious code.

Breach of this section may result in immediate suspension or termination of your account without refund, and may be reported to law enforcement where appropriate.

9. Intellectual Property

All intellectual property rights in the Service itself — including its software, design, trademarks, logos, and content created by beem.pics — are owned by or licensed to us and are protected by copyright, trade mark, and other applicable laws. You may not copy, reproduce, modify, distribute, or create derivative works from any part of the Service without our prior written consent.

Nothing in these Terms transfers any intellectual property rights in the Service to you.

10. Disclaimers and Limitation of Liability

10.1 Service Availability

The Service is provided "as is" and "as available". While we take reasonable steps to ensure the Service is available and functions correctly, we do not guarantee uninterrupted, error-free access. We may carry out maintenance, updates, or changes to the Service which may result in temporary unavailability.

10.2 Limitation of Liability

To the fullest extent permitted by applicable law, beem.pics shall not be liable for:

• Any indirect, incidental, special, or consequential loss or damage.
• Loss of profits, revenue, data, business, or goodwill.
• Any loss arising from your failure to download content before the end of the Download Period.
• Any loss arising from the actions of third parties, including event guests uploading content.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under English law.

Subject to the above, our total aggregate liability to you in connection with the Service shall not exceed the total fees paid by you to us in the 12-month period preceding the event giving rise to the claim.

10.3 Consumer Rights

If you are a consumer, nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015 or any other applicable consumer protection legislation.

11. Third-Party Services

The Service may use third-party infrastructure, payment processors, and other service providers. We are not responsible for the availability, performance, or security of third-party services. Your use of any third-party services may be subject to separate terms and privacy policies.

12. Termination

We may suspend or terminate your access to the Service immediately and without notice if you breach these Terms or if we are required to do so by law. Upon termination, your right to use the Service will cease and we may delete your account and associated content, subject to any legal retention obligations.

You may terminate your account at any time by contacting us at info@beem.pics. Please note that termination does not entitle you to a refund of any fees paid, except where required by law.

13. Modifications to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by displaying a prominent notice on our website. Continued use of the Service after such notice constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.

We recommend that you check this page periodically for updates.

14. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where applicable consumer law gives you the right to bring proceedings in another jurisdiction.

We are committed to resolving disputes fairly and promptly. If you have a complaint, please contact us at info@beem.pics in the first instance and we will endeavour to resolve it as quickly as possible.

15. General

• These Terms, together with our Privacy Policy, constitute the entire agreement between you and beem.pics with respect to your use of the Service.
• If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
• Our failure to enforce any right or provision under these Terms shall not constitute a waiver of that right or provision.
• You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations at any time.
